Construction Accident

Safety is not an option. Unfortunately, most manufacturers of industrial and workplace equipment seem to believe the opposite is true.

Tractors, forklifts, scaffolding, cranes, and other heavy machinery or equipment are often deadly if they are not designed with the worker/operator and knowledge of the real-world applications for which the products will be used.

When these products are not designed properly, in which safety is priority one, then the manufacturer as well as retailer, may be held accountable for the catastrophic injuries that result.

For example, the National Institute of Occupational Safety and Health (NIOSH) and the Occupational Safety Health Administration (OSHA) report that every year forklifts alone account for thousands of serious injuries and numerous deaths.

Oftentimes, forklift manufacturers do not add key safety components and equipment, and instead call these important safety features “options.” They do this in an attempt to deflect responsibility, e.g. the injured victim’s employer could have added anti-intrusion bars to the operator’s cab, but declined to purchase that “option.” These defenses ring hollow, and leave a trail of devastation behind them.

Workplace victims and their families may already be receiving minimal compensation from workers compensation, but there may be a claim against the manufacturer or retailer of the heavy machinery, industrial equipment, tractors, forklifts, scaffolding, or cranes.

Construction Accident Fort Myers

Construction is one of the most dangerous jobs. It has high rates of workplace accidents that often result in severe injuries. Construction workers, laborers, and even supervisors, encounter dangerous conditions veery day. The mechanical equipment is hazardous. The excavators, loaders, scaffolding, and materials each carry risks of severe injury or death.

Many injuries occur on job sites because work conditions expose the laborers or workers to unreasonably functioning safety protection gear or equipment.

Eye injuries. Back injuries. Fall injuries. Electrical burns and electrocution. Heavy machinery or equipment hazards or malfunctions. All workers are exposed to these risks, most of which can be minimized or eliminated by compliance with safety rules or regulations.

Parties may be liable, or held responsible, for these injuries. General contractors, subcontractors, property owners and/or property managers, insurance companies, architects, engineers, or the manufacturers of the heavy machinery, equipment, products or materials used at the site, may be responsible for the devastating injuries.

While workers compensation may in some cases prevent workers from obtaining money damages from the employer for injuries, other non-employer parties – called third parties (i.e. general contractors, subcontractors, property owners and/or property managers, insurance companies, architects, engineers, or the manufacturers of the heavy machinery, equipment, products or materials used at the site) – may be held liable for negligence, or in the case of ultra hazardous activity or product malfunction or defects, under strict liability principles (liability without having to prove negligence or breach of duty).
